Issued in accordance with Title 14 of C.F.R. (Code of Federal Regulations), § 259.4. The aim of this plan is to reduce the inconvenience of passengers during lengthy tarmac delays of aircraft with passengers on board. The plan covers regular and charter flights of LOT Polish Airlines and U.S. airports served regularly by LOT. In addition, it covers LOT's permanent emergency airports in the USA.
The plan includes the following assurances made by LOT towards its customers:
For all flights covered by this plan, LOT will not permit an aircraft to remain on the tarmac for more than four (4) hours before allowing passengers to deplane, unless: (I) The pilot-in-command determines there is a safety-related or security-related reason why the aircraft cannot leave its position on the tarmac to deplane passengers; or (II) air traffic control advises the pilot-in-command that returning to the gate or another disembarkation point elsewhere in order to deplane passengers would significantly disrupt airport operations.
For all flights covered by this plan, LOT will cater for passengers' basic needs by providing adequate food and potable water no later than two (2) hours after the aircraft leaves the gate (in the case of a departure) or touches down (in the case of an arrival) if the aircraft remains on the tarmac, unless the pilot-in-command determines that safety or security considerations preclude such service;
For all flights covered by this plan, LOT will provide passengers with operable lavatory facilities, as well as adequate medical attention if needed if the aircraft remains on the tarmac.
For all flights covered by this plan, the passengers on the delayed flight will receive notifications regarding the status of the delay every 30 minutes if the aircraft remains on the tarmac.
For all flights covered by this plan, the passengers on the delayed flight will be notified not later than 30 minutes after scheduled departure time (including any revised departure time that passengers were notified about before boarding) and every 30 minutes thereafter that they have the opportunity to deplane from an aircraft if it is at the gate or another disembarkation area with the door open and the opportunity to deplane actually exists;
LOT has sufficient resources to implement this plan.
LOT has co-ordinated this plan with airport authorities, the U.S. Customs and Border Protection and the Transportation Security Administration at each of the U.S. airports covered by this plan.
