Objectives and legal grounds for processing:

 

 

1) in order to carry out the passenger complaint procedure in air carriage and legal obligation to which the controller is subject;

2) possible determination, investigation or defence against claims for the purpose of legitimate interests pursued by the controller.

Recipients' categories:

The personal data of persons filing passenger complaints may be provided to:

1) entities related to LOT i.e. companies from the LOT capital group,

2) affiliated entities in the Star Alliance association - to the extent that it is necessary to carry out the complaint procedure carried out within the Star Alliance association,

3) financial institutions, in the event of a complaint being considered and the granting of a specific sum to the passenger - in the scope of carrying out the procedure of transferring funds to the passenger,

4) entities providing selected services to LOT, including intermediary services (also intermediaries acting on behalf of LOT at airports), accounting, legal, courier services, travel agencies - to the extent that it is necessary to provide these services,

5) insurance companies - to the extent to which it is necessary to consider the complaint.

Data transmission
to non-EEA countries:

Passenger's personal data may be forwarded to non-EEA countries on the basis of standard contractual clauses adopted by the European Commission.

Period of retention:

1) In order to carry out the passenger complaint procedure in air carriage and for civil or administrative proceedings, until the claims due to the contract of carriage or the expiration of the limitation period for claims have expired.

2) In order to conduct internal statistics, reports - until the claims due to the contract of carriage or the expiration of the limitation period for claims have expired.

The data subject has the following rights regarding the processing of their personal data, carried out by contacting LOT using any means of communication:

1) right of access to the personal data or the providing aa copy of the personal data processed by LOT,

2) right to rectification of inaccurate personal data

3) right to obtain the erasure of personal data; LOT has the right to refuse to delete data in cases specified by law,

4) right to obtain restriction of processing personal data by indicating which data should be restricted in terms of processing,

5) right to data portability – to receive personal data in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller,

6) right to object to processing personal data , on grounds relating to data subjects particular situation,

7) right to lodge a complaint with a supervisory authority.
