Annex no 1: Conditions of purchase of an electronic flight ticket

ANNEX 1 TO TERMS AND CONDITIONS OF THE ELETRONIC PROVISION OF SERVICES OF 04 JULY 2011. "CONDITIONS OF PURCHASE OF AN ELECTRONIC FLIGHT TICKET"

  1. GENERAL PROVISIONS
    1. This Annex 1 to the Terms and Conditions defines the general conditions of the purchase of an Electronic Flight Ticket (hereafter “Conditions”) via Website.
    2. An Electronic Flight Ticket available via the Website may be purchased subject to acceptance of the provisions indicated below (by unchecking the checkbox) and becoming familiar with the fare conditions concerning the flight selected by the Service Recipient and General Conditions of Carriage available at page of Conditions of Carriage, which form an integral part of the air carriage agreement with LOT Polish Airlines.
  2. ELECTRONIC TICKET PURCHASE SERVICE 
    1. The seller and issuer of Electronic Flight Tickets is the Service Provider.
    2. Bookings and transactions are carried out via the Website using the Amadeus flight ticket booking system.
  3. DEFINITIONS
    1. Electronic Flight Ticket – (also called etix®, “Electronic Ticket”) means a ticket generated and saved in the booking system via Website that entitles the Service Recipient to travel on a given flight. The Electronic Ticket and its order number (booking number) is delivered by e-mail by LOT Polish Airlines to the Service Recipient to the email address indicated by the Service Recipient at the time of booking the Electronic Flight Ticket.
  4. USER'S LIABILITY
    1. The Service Recipient is obliged to purchase and use an Electronic Flight Ticket in accordance with these conditions, General Conditions of Carriage available at: Conditions of Carriage and legal provisions
    2. In particular, the Service Recipient must not purchase an Electronic Flight Ticket using a false name or someone else's name, pay for purchased Electronic Flight Tickets using a false credit card or someone else's credit card without the consent of the owner of the payment card, make bank transfers from someone else's bank account without the consent of its owner or in any other unlawful manner.
    3. If the Service Recipient is a natural person, an Electronic Flight Ticket may be purchased only by a natural person who has full capacity to perform legal transactions.
  5. TICKET BOOKING AND PURCHASE
    1. In order for an Electronic Flight Ticket to be purchased, the booking procedure must be carried out properly in accordance with instructions stated on the Website in the Electronic Flight Ticket purchase panel, the passenger's data must be filled completely, these Conditions must be accepted, and the Service Recipient must make payment for an Electronic Flight Ticket using payment methods indicated on the Website within the time-limit specified by the Service Recipient on the Website.
    2. If the accounting currency of the payment card is not the currency in which the price on the Electronic Flight Ticket is stated, the amount of payment may differ from the price of the purchased Electronic Ticket in accordance with regulations applicable in the payer's bank as a result of currency conversion and exchange rate differences between banks.
    3. The purchase of an Electronic Flight Ticket involves the obligation to make payment for the Electronic Flight Ticket to LOT Polish Airlines.
    4. Upon completion of his booking, the Service Recipient gives his consent to the charging of his card by the system.
    5. If wrong credit card data is stated, the transaction shall be rejected and the Service Recipient shall be redirected to the Electronic Flight Ticket purchase panel. Payments by bank transfer are made automatically during the booking and purchase of the Electronic Flight Ticket through connection with the website of the bank where the Service Recipient has an Internet account.
    6. If during the booking process a payment problem occurs, the Service Recipient will receive a message informing that it is possible to choose the “Keep Your Booking" option, it may be kept and paid up to 3 hours from the time of approval. If the payment problem occurs again, "Keep Your Booking" option will not be available.
    7. The placement of an order for the purchase of an Electronic Flight Ticket is confirmed automatically by a generated e-mail message sent to the e-mail address indicated by the Service Recipient.
    8. A distance agreement for the purchase of an Electronic Flight Ticket is concluded at the moment of receipt of payment for the Electronic Flight Ticket by the Service Provider. The receipt of the fee by the Service Provider is notified to the Service Recipient automatically in a generated e-mail message sent to the e-mail address indicated by the Service Recipient.
  6. ELECTRONIC TICKET REFUND
    1. The Service Recipient is entitled to refund an Electronic Ticket purchased via Website, provided that
      1. the possibility of refunding a ticket is stipulated in the fare used in the Electronic Flight Ticket, and
      2. the Electronic Flight Ticket shall be refunded before the day specified as the date of departure.
    2. An Electronic Flight Ticket may be refunded via Call Center or to LOT Polish Airlines' agents within the time-limit indicated in the fare conditions, if this is allowed by the fare used in the given Electronic Flight Ticket.
    3. An Electronic Flight Ticket to be refunded shall be reported to the relevant Call Center number or to LOT Polish Airlines' agent from whom the ticket was purchased. The list of Call Center phone numbers is available at: www.lot.com.
    4. Depending on the payment method used, the amount due to the Service Recipient for an Electronic Flight Ticket being returned shall be sent directly to the Service Recipient’s bank account or to the Service Recipient's credit card account within 28 days from the date of receipt of the delivery containing the returned Electronic Flight Ticket by LOT Polish Airlines.
    5. Circumstances that prevent reimbursement of the amount owed in the form in which the service was purchased may include:
      1. Exceeding the return date, reserved by the payment system provider.
      2. Closing of the customer's account.
      3. Expiration of the card.

    7. PURCHASE OF AN E-TICKET USING MILES UNDER THE MILES & MORE LOYALTY PROGRAMME 

        a) A Service User who is a member of the Miles & More loyalty programme in the Polish market and has accumulated at least 3,000 miles has the option of covering part of the fare value of the electronic ticket using miles accumulated in the Miles & More loyalty programme.

        b) The use of Miles & More miles for e-ticket redemption only applies to a part of the e-ticket value covering the entire or part of the fare value. Information on the extent to which the fare value can be settled with Miles & More miles will be provided in the booking process for the e-ticket in question. Miles & More miles can only be used in the e-ticket reservation process with the exception of the Booking management process.

        c) Usage of Miles & More mile for part of the fare value of an e-ticket is only possible if the remaining part of the price of the e-ticket is paid by payment card.

        d) In order to benefit from the option of covering part of fare value of the e-ticket price with Miles & More miles, the Service User who is a member of the Miles & More loyalty programme will be asked during the booking process to log on to his/her Miles & More account and enter his/her Miles & More loyalty card number and PIN. 

        e) The minimum number of miles that the Service User who is a member of the Miles & More loyalty programme on the Polish market can spend for part of fare value of the electronic is 3,000 miles.

        f) Subject to the provisions of section 5 above, the Service User who is a member of the Miles & More loyalty programme on the Polish market shall each time decide how many miles are to be used for covering part of the electronic fare value. To this end, a mechanism will be made available in the booking process to configure the number of miles to be redeemed, including the value to be paid by payment card. If a booking includes more than one flight ticket, the Miles & More miles used will reduce the fare for some or all of the flight tickets in the booking.

        g) If the Service User who is a member of the Miles & More loyalty programme on the Polish market takes advantage of the opportunity to redeem Miles & More miles in order to cover any part of the e-ticket price it means that the Service User as a member of the Miles & More loyalty programme has agreed to the use of miles to pay for the e-ticket.

        h) If the payment for an e-ticket using Miles & Mores miles is unsuccessful the Miles & More miles used will be refunded to the account of the Service User who is a member of the Miles & More loyalty programme.

        i) If the Service User returns an e-ticket purchased with Miles & More miles the Miles & More miles used to cover part of the fare value of the returned e-ticket will be refunded to the Service User's Miles & More loyalty programme account. In the event that the e-ticket is returned with a return fare charge and the value of this charge cannot be deducted in full from the value of the fare paid by payment card, the remaining part of the charge will be deducted from the value of the Miles & More miles intended to cover the fare value. In other circumstances, the provisions of the ELECTRONIC TICKET REFUND section of this Annex 1 apply accordingly.

        j) The option covering part of fare value of the e-ticket with Miles & More miles is available for e-tickets purchased for certain flight types. The information about the exclusion of the possibility of redeeming Miles & More miles for an e-ticket for any specific flight will be provided in the booking process for the flight concerned.  

        k) LOT Polish Airlines reserves the right to a temporary suspension of the possibility to use Miles & More miles to cover part of the fare value for e-tickets. The information about any temporary suspension of the redemption of Miles & More miles for e-tickets will be communicated to participants in the Miles & More loyalty programme.
