Annex 2b) Regulations of Extra Legroom Bidding

ANNEX NO. 7 TO THE TERMS AND CONDITIONS OF THE ELECTRONIC PROVISION OF SERVICES BY PLL LOT S.A. of 11 March 2024.

1. A Passenger is entitled to submit an offer to LOT Polish Airlines concerning the purchase of a seat with extra legroom (hereinafter "Extra Legroom Bidding Offer") on a flight operated by LOT Polish Airlines for which they have already purchased an air ticket in the LOT Economy Class.

2. Offers may be submitted only for selected flights operated by LOT Polish Airlines and for LOT Polish Airlines flights for which the Service Recipient has already purchased an air ticket in the LOT Economy Class.

3. An Extra Legroom Bidding Offer can be submitted either through the Website by completing the form in the "Extra Legroom Bidding" section, in accordance with the instructions provided therein, or through a link contained in the e-mail message sent to the Passenger in connection with the purchased air ticket.

4. By submitting an Extra Legroom Bidding Offer, the Passenger accepts that the Extra Legroom Bidding Offer is binding on them from the time of its submission until its acceptance by LOT Polish Airlines. LOT Polish Airlines shall inform the Passenger by e-mail about acceptance or rejection of the Extra Legroom Bidding Offer no later than 23 hours before the scheduled time of the flight to which the Extra Legroom Bidding Offer applies.

5. Acceptance of an Extra Legroom Bidding Offer by Lot Polish Airlines shall be conditional on the availability of seats with extra legroom in the LOT Economy Class on a given aircraft.

6. Shall an Extra Legroom Bidding Offer be accepted, LOT Polish Airlines does not guarantee allocating a specific seat with extra legroom on a given aircraft.

7. An Extra Legroom Bidding Offer can be modified or cancelled by the Passenger before it is accepted by LOT Polish Airlines.

8. If the original booking covers more than one person, the Extra Legroom Bidding Offer shall cover all the persons named in the original booking.

9. If the Passenger submits an Extra Legroom Bidding Offer on behalf of another person(s), the Passenger should hold an appropriate authorisation to act on their behalf.

10. If the Extra Legroom Bidding Offer refers to more than one person, the unit price offered for the Extra Legroom Bidding Service by the Passenger will be multiplied by the number of people covered by the original booking. The Passenger shall be informed about the total amount due for the Extra Legroom Bidding Service for all persons concerned.

11. The submission of an Extra Legroom Bidding Offer and its acceptance by LOT Polish Airlines means that the Passenger resigns from the previously purchased My Favourite Seat service which, for objective reasons, cannot be provided, and LOT Polish Airlines shall not be obliged to refund Passenger for the costs associated with its purchase. In such a case, however, the Passenger may use the purchased My Favourite Seat service on another flight within 24 months (say: twenty four months) from the date of issue of a document for that Service, provided that:

  • the Service is used by the Passenger for whom it was originally purchased;
  • the Service is available and can be provided during or in relation with a new flight.

12. The acceptance of an Extra Legroom Bidding Offer by LOT Polish Airlines shall not change the tariff terms for the originally purchased air ticket as regards the terms of cancellation and return of the ticket, charges for a booking change, and luggage limits. The said terms shall remain the same as for the air ticket originally purchased in the LOT Economy Class.

13. If the Extra Legroom Bidding Offer is accepted by LOT Polish Airlines, the Passenger shall be obliged to pay the amount suggested in the Extra Legroom Bidding Offer. The Passenger's credit card will be charged for the amount indicated in the Extra Legroom Bidding Offer. Where the Offer applies to more than one person, the provisions of Point 9 of these Conditions shall apply. The total amount due for the Extra Legroom Bidding Service shall cover all the potential taxes and charges due in advance for Extra Legroom Bidding.

14. If the Extra Legroom Bidding Offer is accepted by LOT Polish Airlines, the Passenger shall receive from LOT Polish Airlines an e-mail message with information that their Extra Legroom Bidding Offer has been accepted and that Extra Legroom Bidding has been granted.

15. The granted Extra Legroom Bidding may be used only by the Passenger or by persons named in the original booking and only for the LOT Polish Airlines flight for which the air ticket was originally purchased, and it may not be transferred in whole or in part to another person or to a flight other than the one for which the air ticket was originally purchased, subject to Point 18 below.

16. If the Extra Legroom Bidding Offer is not accepted by LOT Polish Airlines, of which the Passenger shall be informed by e-mail, the Passenger's credit card will not be charged and the Passenger shall retain the originally purchased air ticket and extra services purchased prior to the submission and receipt of the Extra Legroom Bidding Offer.

17. Once the Extra Legroom Bidding Offer is accepted by LOT Polish Airlines, a refund or exchange for reasons attributable to the Passenger or person(s) covered by the original booking will no longer be possible.

18. Where the purchased Extra Legroom Bidding Service cannot be used for reasons attributable to the Passenger or the person(s) covered by the original booking, the Passenger may use other purchased Extra Services, including My Favourite Seat, during or in relation with a new flight within 24 months (say: twenty four months) from the date of issue of a document for the Extra Service concerned, provided that:

  • the Service is used by the Passenger for whom it was originally purchased;
  • the Service is available and can be provided during or in relation with a new flight.

19. LOT Polish Airlines shall refund the full amount paid by the Passenger for the Extra Legroom Bidding Service if either of the following circumstances occurs and is attributable to LOT Polish Airlines:

  • the flight to which Extra Legroom Bidding applies has been cancelled;
  • the flight to which Extra Legroom Bidding applies has been cancelled and LOT Polish Airlines rebooked to another flight but in the class originally booked by the Passenger where seats with extra legroom are not available;
  • the flight to which Extra Legroom Bidding applies has been cancelled and LOT Polish Airlines has rebooked to another flight operated by another carrier;
  • the Extra Legroom Bidding Service cannot be provided for reasons including, but not limited to, a changes of the aircraft type and a delay of a transit flight which caused the Passenger to miss the flight to which the Extra Legroom Bidding Service applies.

20. Where, due to circumstances attributable to LOT Polish Airlines, the flight to which the Extra Legroom Bidding Service applies has been cancelled and LOT Polish Airlines has rebooked to another flight, the Extra Legroom Bidding Offer made in respect of the original booking may be provided on a new flight subject to the availability of seats with extra legroom on that new flight. Where no seats with extra legroom are available on the new flight, the provisions of Point 19(b) of these Conditions shall apply

21. Any amounts paid for the Extra Legroom Bidding Service that are subject to a refund shall be refunded to the Passenger's credit card used for paying for the Service. The refund shall be made in the currency in which the Service was paid for.

22. These Conditions are subject to Polish law.

23. Applicable to these Conditions are the General Conditions of Carriage in LOT Polish Airlines, available in the "Regulations" section.
