'Instant Upgrade' Terms of Service

ANNEX NO. 7 TO THE TERMS AND CONDITIONS OF THE ELECTRONIC PROVISION OF SERVICES BY PLL LOT S.A. of 11 March 2024.

 

1. A Passenger is entitled to purchase the service concerning an upgrade of the travel standard on a flight operated by LOT Polish Airlines for which they have already purchased an air ticket in the LOT Economy Class or LOT Premium Economy Class under the following conditions:

  • From the LOT Economy Class in which the air ticket has been originally purchased up to the LOT Business Class,
  • From the LOT Premium Economy Class in which the air ticket has been originally purchased up to the LOT Business Class,
  • From the LOT Economy Class in which the air ticket has been originally purchased up to the LOT Premium Economy Class.

2. The "Instant Upgrade" Service may be purchased only for selected flights operated by LOT Polish Airlines and for LOT Polish Airlines flights for which the Passenger has already purchased an air ticket in the LOT Economy Class or LOT Premium Economy Class.

3. The "Instant Upgrade" Service can be purchased 72 hours prior to departure through the Website by completing the form in the "LOT Upgrade" section, in accordance with the instructions provided therein.

4. The "Instant Upgrade" Service is conditional on the availability of seats in the higher class to which the Upgrade applies.

5. Once the "Instant Upgrade" Service is purchased, it cannot be modified or cancelled.

6. If the original booking covers more than one person, the purchase of the Upgrade shall cover all the persons named in the original booking.

7. If the Passenger purchases the Upgrade on behalf of another person(s), the Passenger should hold an appropriate authorisation to act on their behalf.

8. If the purchase of the Upgrade refers to more than one person, the unit price offered for the Upgrade by Passenger will be multiplied by the number of people covered by the original booking. The Passenger shall be informed about the total amount due for the Upgrade for all persons concerned.

9. The purchase of the "Instant Upgrade" Service means that the Passenger resigns from the previously purchased My Favourite Seat Service which, for objective reasons, cannot be provided in a higher class, LOT Polish Airlines shall not be obliged to refund Passenger for the costs associated with its purchase. In such a case, however, the Passenger may use the purchased My Favourite Seat service on another flight within 24 months (say: twenty four months) from the date of issue of a document for that Service, provided that:

  • the Service is used by the Passenger for whom it was originally purchased;
  • the Service is available and can be provided during or in relation with a new flight.

In the case of services previously purchased by the Passenger such as Fast Track, Business Lounge or Premium Class Meal, which are available free of charge in higher classes, LOT Polish Airlines shall not be obliged to refund the Passenger for the costs associated with the purchase of those Services prior to the purchase of the Upgrade and its acceptance by LOT Polish Airlines.

10. The purchase of the Upgrade shall not change the tariff terms for the originally purchased air ticket as regards the terms of cancellation and return of the ticket, charges for a booking change, and luggage limits. The said terms shall remain the same as for the air ticket originally purchased in the LOT Economy Class or LOT Premium Economy Class.

11. Where the "Instant Upgrade" Service is purchased, the Passenger's credit card will be charged for the amount indicated at "buy now" in the Upgrade purchase form. Where the purchase applies to more than one person, the provisions of Point 8 of these Conditions shall apply. The total amount due for the Upgrade shall cover all the potential taxes and charges due in advance for the Upgrade.

12. The purchased Upgrade may be used only by the Passenger or by persons named in the original booking and only for the LOT Polish Airlines flight for which the air ticket was originally purchased, and it may not be transferred in whole or in part to another person or to a flight other than the one for which the air ticket was originally purchased, subject to Point 17 below.

13. If the Upgrade purchase is not processed correctly, of which the Passenger shall be informed by e-mail, the Passenger's credit card will not be charged and the Passenger shall retain the originally purchased air ticket and extra services purchased prior to the attempted purchase of the "Instant Upgrade" Service.

14. The Upgrade is not subject to any refunds or exchange if the purchased Service cannot be used for reasons attributable to the Passenger or the person(s) covered by the original booking.

15. Where the purchased Upgrade cannot be used for reasons attributable to the Passenger or the person(s) covered by the original booking, the Passenger may use other purchased Extra Services, including My Favourite Seat, Fast Track, Business Lounge and Premium Class Meal, during or in relation with a new flight within 24 months (say: twenty four months) from the date of issue of a document for the Extra Service concerned, provided that:

  • the Service is used by the Passenger for whom it was originally purchased;
  • the Service is available and can be provided during or in relation with a new flight.

16. LOT Polish Airlines shall refund the full amount paid by the Service Recipient for the Upgrade if either of the following circumstances occurs and is attributable to LOT Polish Airlines:

  • the flight to which the Upgrade applies has been cancelled;
  • the flight to which the Upgrade applies has been cancelled and LOT Polish Airlines has rebooked to another flight but in the class of the original booking;
  • the flight to which the Upgrade applies has been cancelled and LOT Polish Airlines has rebooked to another flight operated by another carrier;
  • the Upgrade cannot be provided for reasons including, but not limited to, a change of the aircraft type and a delay of a transit flight which caused the Passenger to miss the flight to which the Upgrade applies.

17. Where, due to circumstances attributable to LOT Polish Airlines, the flight to which the Upgrade applies has been cancelled and LOT Polish Airlines has rebooked to another flight, the Upgrade Service can be provided on a new flight subject to the availability of seats in the higher classes stipulated in the Upgrade. Where no seats in higher classes are available on the new flight, the provisions of Point 16(b) of these Conditions shall apply.

18. Any amounts paid for the Upgrade that are subject to a refund shall be refunded to the Passenger's credit card used for paying for the Upgrade. The refund shall be made in the currency in which the Upgrade was paid for.

19. These Conditions are subject to Polish law.

20. Applicable to these Conditions are the General Conditions of Carriage in LOT Polish Airlines, available in the "Regulations" section.
